TERMS & CONDITIONS
These Terms & Conditions govern all photography services provided by Gorda Visuals. By submitting a booking request, signing a Photography Services Agreement, making any payment, or participating in any photography session or event provided by Gorda Visuals, the client acknowledges that they have read, understood, and agree to these Terms & Conditions.
✔ COPYRIGHT OWNERSHIP
All photographs, digital images, videos (if applicable), and other creative works produced by Gorda Visuals remain the sole and exclusive intellectual property of Gorda Visuals. Payment for photography services does not transfer copyright ownership. Upon full payment, the client receives a non-exclusive, non-transferable personal-use license to download, print, and share delivered photographs for personal, non-commercial use.
Photographs may not be:
✔ Sold
✔ Licensed
✔ Transferred
✔ Used for advertising
✔ Used for commercial purposes
✔ Used for fundraising
✔ Used on merchandise
✔ Entered into contests by third parties
✔ Edited in a manner that misrepresents the photographer's work
✔ Used for business promotion without prior written permission from Gorda Visuals.
✔ PHOTOGRAPHER'S ARTISTIC STYLE
Photography is an artistic service. The client understands and agrees that all creative decisions—including composition, lighting, posing, editing style, cropping, color grading, exposure, image selection, and overall artistic presentation—are made at the photographer's professional discretion. By booking with Gorda Visuals, the client acknowledges that they are familiar with the photographer's editing style and portfolio. Requests for refunds or complimentary re-editing based solely on artistic preference will not be accepted.
✔ MODEL RELEASE
Unless the client declines in writing before the session or event, the client grants Gorda Visuals permission to use photographs from the session or event for:
✔ Portfolio
✔ Website
✔ Social Media
✔ Marketing Materials
✔ Advertisements
✔ Printed Promotional Materials
✔ Business Displays
Clients who do not wish to grant permission may decline on the Photography Services Agreement before photography services begin.
✔ IMAGE DELIVERY & STORAGE
Completed galleries will be delivered through a secure private online gallery. Clients are responsible for downloading and backing up all photographs immediately after gallery delivery. Gorda Visuals will make reasonable efforts to retain edited photographs after delivery; however, long-term storage is not guaranteed. Once a gallery expires or files have been removed from storage, Gorda Visuals is not responsible for lost images and cannot guarantee that photographs can be recovered or re-delivered.
✔ GALLERY DELIVERY
Gallery delivery times depend on:
✔ Selected package
✔ Number of images
✔ Current workload
✔ Editing requirements
✔ Holidays
✔ Scheduling
Most galleries are delivered within approximately one week, although delivery times are estimates only and are not guaranteed. Clients who purchase the Priority Editing Add-On will have their gallery moved to the front of the editing queue for faster delivery.
✔ IMAGE EDITING
Only high-quality edited photographs selected by Gorda Visuals will be delivered. RAW (unedited) image files remain the exclusive property of Gorda Visuals and will not be released, sold, or transferred under any circumstances. Additional editing requests may be completed at the photographer's discretion and may require an additional fee.
✔ IMAGE REQUESTS
Gorda Visuals will make every reasonable effort to capture requested individuals, moments, activities, and photographs.
However, specific photographs cannot be guaranteed due to factors including:
✔ Time limitations
✔ Event conditions
✔ Lighting
✔ Weather
✔ Crowd size
✔ Participant availability
✔ Venue restrictions
✔ Safety concerns
✔ Other unforeseen circumstances
Coverage is based on the package selected and the amount of time booked.
✔ CLIENT COOPERATION
The client agrees to provide accurate booking information and cooperate throughout the photography session or event.
Gorda Visuals is not responsible for missed photographs resulting from:
✔ Late arrivals
✔ Schedule changes
✔ Failure to communicate important requests
✔ Venue restrictions
✔ Third-party interference
✔ Lack of cooperation from participants
✔ Events occurring outside of the photographer's reasonable control
Clients are encouraged to communicate any important individuals, moments, or requests before photography begins.
✔ PAYMENT POLICY
Full payment must be received before photography services begin unless otherwise agreed upon in writing. Certain bookings require a non-refundable deposit to reserve the requested date and time. The deposit amount varies depending on the type of event, coverage length, and selected package. The deposit is not an additional fee and will be credited toward the client's total booking balance. Failure to submit required payments may result in cancellation of the booking.
✔ CANCELLATION & RESCHEDULING
Clients are encouraged to notify Gorda Visuals as soon as possible if they need to cancel or reschedule a booking.
✔ Non-refundable deposits will not be refunded unless otherwise agreed to in writing by Gorda Visuals.
✔ Rescheduling requests are subject to availability and are not guaranteed.
✔ If Gorda Visuals is unable to accommodate a requested reschedule, the original cancellation policy will remain in effect.
✔ Any remaining balance paid beyond the non-refundable deposit may be refunded at Gorda Visuals' discretion and in accordance with the Photography Services Agreement.
✔ LIMITATION OF LIABILITY
Gorda Visuals will exercise reasonable care in providing photography services and protecting captured images.
Gorda Visuals shall not be responsible for delays, interruptions, or the inability to perform photography services due to circumstances beyond reasonable control, including but not limited to:
✔ Severe weather
✔ Equipment failure
✔ Illness
✔ Venue restrictions
✔ Power outages
✔ Government actions
✔ Public emergencies
✔ Acts of God
✔ Other unforeseen circumstances
If photographs become permanently lost or unrecoverable due to circumstances beyond Gorda Visuals' reasonable control, liability shall be limited to the total amount paid for the affected booking. To the fullest extent permitted under Delaware law, Gorda Visuals shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.
✔ FORCE MAJEURE
Gorda Visuals shall not be considered in breach of these Terms & Conditions if photography services cannot be performed because of circumstances beyond reasonable control, including:
✔ Severe weather
✔ Natural disasters
✔ Public emergencies
✔ Government restrictions
✔ Venue closures
✔ Power failures
✔ Illness
✔ Acts of God
✔ Other unforeseen events
Whenever reasonably possible, efforts will be made to reschedule the booking.
✔ EQUIPMENT DAMAGE
Clients are financially responsible for damage to photography equipment caused by themselves or members of their party through:
✔ Negligence
✔ Intentional misconduct
✔ Horseplay
✔ Failure to follow reasonable safety instructions
The client may be responsible for:
✔ Repair costs
✔ Replacement costs
✔ Rental equipment
✔ Shipping expenses
✔ Labor costs
✔ Diagnostic fees
✔ Applicable taxes
✔ Documented business losses
Gorda Visuals reserves the right to suspend photography services and withhold image delivery until all equipment-related balances have been paid.
✔ CLIENT CONDUCT
Gorda Visuals is committed to providing a safe, professional, and respectful environment.
Photography services may be immediately suspended or terminated without refund if any client, participant, or guest engages in:
✔ Harassment
✔ Threatening behavior
✔ Physical violence
✔ Illegal activity
✔ Unsafe conduct
✔ Behavior that places the photographer or others at risk
Gorda Visuals reserves the right to leave any session or event if safety becomes a concern.
✔ SOCIAL MEDIA & IMAGE SHARING
Clients are welcome to share delivered photographs for personal, non-commercial use. When sharing photographs online, crediting Gorda Visuals is greatly appreciated.
Clients may not:
✔ Remove watermarks from preview images
✔ Claim the photographs as their own work
✔ Sell photographs
✔ Use photographs for commercial purposes without written permission
✔ Alter photographs in a way that misrepresents the photographer's work
✔ COLLECTIONS & LEGAL ENFORCEMENT
Failure to pay outstanding balances may result in collection efforts or legal action as permitted by law.
Gorda Visuals reserves the right to recover:
✔ Unpaid balances
✔ Court costs
✔ Collection fees
✔ Attorney's fees (where permitted by law)
✔ Equipment repair expenses
✔ Other reasonable costs incurred while enforcing these Terms & Conditions
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Delaware.
✔ INDEPENDENT CONTRACTOR
Gorda Visuals operates as an independent contractor. Nothing contained within these Terms & Conditions shall be interpreted as creating an employer-employee relationship, partnership, joint venture, or agency relationship between Gorda Visuals and the client.
✔ CHANGES TO THESE TERMS
Gorda Visuals reserves the right to update or modify these Terms & Conditions at any time. The version in effect on the date a booking is confirmed shall govern that booking.
✔ ENTIRE AGREEMENT
These Terms & Conditions, together with the Photography Services Agreement, Privacy Policy, Pricing Information, Disclaimers, and any additional written policies provided by Gorda Visuals, constitute the entire agreement between Gorda Visuals and the client. These documents supersede all prior discussions, representations, negotiations, or agreements relating to the photography services provided.
✔ CLIENT ACKNOWLEDGMENT
By submitting a booking request, signing the Photography Services Agreement, making any payment, or participating in photography services provided by Gorda Visuals, the client acknowledges that they:
✔ Have read these Terms & Conditions in their entirety.
✔ Understand and agree to all terms contained within this document.
✔ Agree to comply with all business policies established by Gorda Visuals.
✔ Understand that these Terms & Conditions form part of the legally binding Photography Services Agreement between the client and Gorda Visuals.
